End-User License Agreement

Introduction

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Vladyslav Fedoniuk ("I", "me", "my") for the use of the TabChart software application, including any components, updates, enhancements, or subsequent versions thereof ("Software"), as well as any associated media, printed materials, and electronic documentation ("Documentation").

Grant of License

I grant you a personal, non-exclusive, non-transferable, limited license to install and use the Software on your Windows device(s) free of charge, as long as you comply with the terms of this EULA. This license allows you to use the Software on multiple devices you own or control.

Restrictions

You agree not to:

• Use the Software in any manner that exceeds the rights granted under this EULA
• Modify, reverse engineer, decompile, or disassemble the Software
• Distribute copies of the Software to third parties
• Remove or alter any proprietary notices or labels on the Software
• Use the Software for any unlawful purpose or in a way that violates any applicable law or regulation
• Use the Software to develop a competing product or service
• Bypass or attempt to bypass any security or license enforcement mechanisms

Ownership

All title, ownership rights, and intellectual property rights in and to the Software and Documentation are owned by Vladyslav Fedoniuk. The Software is licensed, not sold. You do not acquire any ownership rights in the Software or Documentation through this EULA.

Automatic Updates

The Software may automatically download and install updates from time to time. These updates are designed to improve and enhance the Software and may take the form of bug fixes, enhanced functions, or completely new versions. You may disable automatic updates in the Software settings, but I strongly recommend keeping your Software updated for optimal performance and security.

Data Collection

The Software operates locally on your device and does not automatically transmit any user data to me. You may voluntarily submit error logs to help diagnose technical issues. No personally identifiable information or sensitive data is collected through the Software. For information about data collected through my website, please see my Privacy Policy.

No Warranties

The Software is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Software will meet your requirements, operate without interruption, or be error-free. The Software is provided free of charge and you assume all risk for its use.

Limitation of Liability

To the maximum extent permitted by applicable law, I shall not be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use this Software, even if I have been advised of the possibility of such damages. As this is free software, you agree that my entire liability under any provision of this EULA shall be limited to €1.

Indemnification

You agree to indemnify, defend, and hold harmless Vladyslav Fedoniuk from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or in any way related to your use of the Software or your breach of this EULA.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software.

Export Restrictions

You agree not to export or re-export the Software in violation of any applicable export control laws or regulations, including without limitation the laws and regulations of Poland, the European Union, and the United States.

Governing Law and Jurisdiction

This EULA will be governed by and construed in accordance with the laws of Poland. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Rzeszow, Poland.

General

This EULA constitutes the entire agreement between you and Vladyslav Fedoniuk concerning the Software and supersedes any prior agreements, representations, or understandings. If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

I reserve the right to modify this EULA at any time. Such modifications will be effective immediately upon posting on my website or through notification within the Software. Your continued use of the Software after such modifications constitutes your acceptance of the modified terms.
